General Terms and Conditions of Sale (GTC)

These General Terms and Conditions of Sale (hereinafter "GTC") apply to all orders placed by any person (hereinafter "the Customer") via the website https://www.kanumera.com, in their version in force at the time of the order. The Customer declares to have read and accepted the GTC before validating their order. Validation of the order constitutes full and complete acceptance of these GTC.
All our deliveries, services, and offers are exclusively governed by these GTC, unless otherwise agreed in writing. Any conflicting terms from the Customer will not be accepted unless expressly agreed upon.
Definitions:

"Consumer": any natural person acting for purposes not related to their commercial, industrial, artisanal, liberal, or agricultural activity.

"Professional": any natural or legal person acting for purposes related to their professional activity.

"Customer": refers to both Consumers and Professionals.

"Business day": any day of the week except Saturdays, Sundays, and public holidays in France.
Article 1 – Prices
1.1 Product and/or service prices are shown in euros, inclusive of all taxes (VAT and any other applicable taxes), excluding handling and shipping fees.
1.2 KANUMERA reserves the right to change its prices at any time. However, products are billed based on the prices in effect at the time the order is confirmed.
1.3 Handling and shipping fees are specified during the ordering process and added to the total amount to be paid.
Article 2 – Order and Customer Account
2.1 When registering, the Customer agrees to provide accurate, complete, and up-to-date information. The login and password are strictly personal and confidential.
2.2 Any fraudulent use of the website or its data is prohibited and may result in the suspension or deletion of the Customer's account.
2.3 Registration is free and can be canceled at any time by sending a request via email to: kanumera@kanumera.com
2.4 In the event of force majeure or maintenance, KANUMERA shall not be held liable for temporary unavailability of the website.
Article 3 – Payment Terms
3.1 The Customer may pay for their order by credit card. Payment is due immediately and in full upon ordering.
3.2 No banking data is collected by KANUMERA. Payment is processed via a secure payment service provider.
3.3 Order forms and invoices are archived on a reliable and durable medium.
Article 4 – Order Confirmation
4.1 The order is considered final and binding once confirmed by the Customer, which constitutes acceptance of these GTC.
Article 5 – Transfer of Ownership
5.1 Ownership of the ordered products is transferred to the Customer upon full payment of the price and delivery of the products.
Article 6 – Right of Withdrawal (Consumers only)
6.1 In accordance with Articles L221-18 to L221-28 of the French Consumer Code, Consumers have a 14-day withdrawal period from the date of receipt of the products, without having to justify their decision.
6.2 In case of withdrawal, only returned products that are complete, in perfect condition, and in their original packaging will be refunded. Return shipping costs are the responsibility of the Customer.
6.3 The Customer may exercise their right of withdrawal by sending an email to: kanumera@kanumera.com. A standard withdrawal form is available on the website.
6.4 Refunds will be processed within 14 days of receiving the returned product, using the same payment method as used for the order, unless otherwise agreed.
6.5 In the event of an error on our part, return shipping costs will be reimbursed up to a maximum of €12 upon presentation of a receipt.
Article 7 – Legal Warranties
7.1 The Customer benefits from the legal warranty of conformity (Articles L217-3 to L217-20 of the French Consumer Code) and the warranty against hidden defects (Articles 1641 to 1649 of the French Civil Code).
7.2 Any request should be sent to: kanumera@kanumera.com as soon as possible.
Article 8 – Governing Law – Disputes – Mediation
8.1 This contract is governed by French law. The language of the contract is French.
8.2 In the event of a dispute, the Customer agrees to first seek an amicable solution by contacting KANUMERA.
8.3 The Customer may also use a consumer mediation service via the European Online Dispute Resolution platform: https://ec.europa.eu/consumers/odr
8.4 If no amicable solution is found, the dispute will be submitted to the competent courts in accordance with standard legal rules.
Article 9 – Personal Data
9.1 Personal data collected is necessary for processing orders. It may be shared with service providers involved in order fulfillment.
9.2 In accordance with the GDPR and the amended French Data Protection Act of January 6, 1978, the Customer has the right to access, rectify, oppose, erase, and port their personal data.
9.3 To exercise these rights, the Customer may contact: kanumera@kanumera.com. The request must be signed and accompanied by proof of identity.
